  3.                            License Agreement

  5. B & E Software Engineering hereby grants you a non-exclusive, non-
  6. transferable license to use this product on one Central Processing
  7. Unit (CPU) only.
  8.  
  9. I understand that the TECHY logo, product names, software, manuals,
  10. documentation and other materials are either patented, copyrighted,
  11. trademarked or owned by B & E Software Engineering as trade secrets or
  12. proprietary information.  I agree not to remove any product
  13. identification or notices of such proprietary restrictions from
  14. B & E Software Engineering products.
  15.  
  16. I agree that I will only make copies for use as archival back-up
  17. copies, and only if such copies are for my personal use. Any copying
  18. of materials or documentation is prohibited.
  19.  
  20. B & E Software Engineering warrants that the magnetic media on which
  21. the enclosed computer program is recorded is free from defects in
  22. materials and workmanship under normal use. B & E Software Engineering
  23. warrants that the computer program will perform substantially in
  24. accordance with the user manual. The warranty covering the magnetic
  25. media  and computer program is made only for ninety (90) days from the
  26. date of delivery of the program to me or my company as a user.

  28. I agree to return this defective item shipping prepaid during the
  29. warranty period, and B & E Software Engineering must receive it within
  30. thirty (30) days of the end of this warranty period. I agree to either
  31. insure the defective item being returned or assume the risk of loss or
  32. damage in transit. All warranty claims must be addresses to:

  38. Any claim under the above warranty must include a dated proof of the
  39. date of delivery, such as a copy of my receipt or invoice. I agree to
  40. return the defective item shipping prepaid to B & E Software
  41. Engineering during the warranty period.

  43. I agree that B & E Software Engineering liability for damages to the
  44. user or others resulting from use of the computer program shall not
  45. exceed the amount of the licence fee payable to B & E Software
  46. Engineering under this Agreement.

  48. I AGREE THAT B & E Software Engineering SHALL NOT IN ANY CASE BE LIABLE
  49. FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR
  50. DAMAGES ARISING FROM ANY BREACH OF THESE WARRANTIES, EVEN IF B & E
  51. Software Engineering OR ITS AGENT HAS BEEN ADVISED OF THE POSSIBILITY
  52. OF SUCH DAMAGES.

  54. This means that B & E Software Engineering is not responsible for any
  55. costs, including, but not limited to, those incurred as a result of
  56. lost profits or revenue, loss of use of the computer program, loss of
  57. data, costs of recreating lost data, the cost of any substitute
  58. program, claims by any party other than me, or for other similar costs.
  59. I understand that some states do not allow the exclusion or limitation
  60. of incidental or consequential damages, so the above limitation or
  61. exclusion may not apply to me.

  63. I agree that any breach of one or more of the provisions of this
  64. agreement by me shall constitute an immediate termination of this
  65. agreement. Nevertheless, I agree that in the event of such termination,
  66. all provisions of this agreement which protect the rights of B & E
  67. Software Engineering will remain in force.
